Affiliate Partner Program Terms & Conditions
These Affiliate Partner Program Terms & Conditions (“Terms”) govern participation in The POWER of Elderberries® Affiliate Partner Program (“Program”). By applying to or participating in the Program, you agree to these Terms.
Participation in the Program is subject to approval by The POWER of Elderberries®. Submission of an application does not guarantee acceptance.
1. Affiliate Partner Program
The Program allows approved Affiliate Partners to share The POWER of Elderberries® with their communities through an assigned referral link and/or referral code.
Approved Affiliate Partners may earn commission on qualifying purchases made by new customers through their referral link or code. Unless expressly stated otherwise by The POWER of Elderberries®, purchases made by existing or returning customers are not eligible for commission.
Affiliate Partners are independent participants in the Program and are not employees, agents, representatives, franchisees, joint venturers, or legal partners of The POWER of Elderberries®.
2. Eligibility & Approval
Applicants must provide accurate and complete information when applying to the Program.
The POWER of Elderberries® reserves the right to approve or decline any application at its discretion and may consider factors including brand alignment, intended promotional methods, audience, business or organizational activities, and compliance with these Terms.
Program participation may be limited, suspended, or terminated at any time in accordance with these Terms.
3. Referral Links, Codes & Attribution
Approved Affiliate Partners will receive a unique referral link and may also receive a referral code for use when sharing The POWER of Elderberries®.
Commissions are earned only on qualifying purchases properly attributed to the Affiliate Partner through the tracking methods supported by our affiliate platform.
Affiliate Partners are responsible for using their assigned link or code correctly. The POWER of Elderberries® cannot guarantee attribution when a customer does not use the appropriate referral method or when tracking is prevented or interrupted by factors outside our control.
Affiliate Partners may not place orders through their own referral link or code for the purpose of earning commissions on personal purchases.
4. Commissions
Approved Affiliate Partners may earn commission on eligible purchases made through their referral link or code.
Current commission rates, eligible products or orders, attribution rules, and payment terms are established by The POWER of Elderberries® and may be updated from time to time.
Unless expressly stated otherwise, commissions are calculated on the eligible merchandise subtotal after discounts and exclude shipping charges, taxes, refunds, returns, cancellations, gift cards, and other non-commissionable amounts.
No commission is earned on refunded, canceled, fraudulent, chargeback, or otherwise ineligible transactions. Previously credited commissions associated with such transactions may be reversed.
5. Payments
Affiliate Partners are responsible for completing all information required by the affiliate platform to receive commission payments.
Affiliate Partners are responsible for any taxes, reporting requirements, or other obligations associated with compensation received through the Program.
The POWER of Elderberries® may withhold payment while investigating suspected fraud, misuse, violation of these Terms, or other irregular activity.
6. Sharing & Promotion
We encourage Affiliate Partners to share The POWER of Elderberries® authentically and in ways that are appropriate for their communities.
Affiliate Partners must clearly disclose their relationship with The POWER of Elderberries® whenever promoting products in accordance with applicable Federal Trade Commission requirements and other applicable laws and regulations.
Disclosures should be clear and easily understood by the audience and should not be hidden or presented in a way that makes the relationship difficult to recognize.
Affiliate Partners may not engage in misleading advertising, spam, deceptive practices, false representations, unauthorized paid advertising using our brand name, or any promotional activity that could reasonably harm The POWER of Elderberries® or its reputation.
7. Product & Wellness Claims
The POWER of Elderberries® products are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease.
Affiliate Partners may only make product, ingredient, wellness, or other claims that are consistent with information and approved materials provided by The POWER of Elderberries®.
Affiliate Partners may not represent that our products diagnose, treat, cure, or prevent disease or make unauthorized medical or therapeutic claims.
Affiliate Partners should not alter approved product claims in a way that changes their meaning or creates claims that The POWER of Elderberries® has not authorized.
Health and wellness professionals participating in the Program remain solely responsible for complying with the laws, professional standards, licensing requirements, and ethical obligations applicable to their own practice or profession.
8. Brand & Intellectual Property
The POWER of Elderberries®, The P.O.E., Let Nature Do The Healing®, product names, logos, photographs, graphics, written materials, and other brand assets are owned by or licensed to The POWER of Elderberries® and may be protected by trademark, copyright, or other intellectual property laws.
Affiliate Partners may use brand materials provided or expressly approved for Program participation solely for the purpose of promoting The POWER of Elderberries® in accordance with these Terms.
Affiliate Partners may not alter our logos, product packaging, photographs, claims, or branded materials in a misleading or unauthorized manner.
Participation in the Program does not transfer ownership of any intellectual property to an Affiliate Partner.
9. Discounts, Promotions & Representations
Affiliate Partners may only advertise discounts, offers, promotions, free shipping thresholds, product pricing, or other incentives that are currently authorized by The POWER of Elderberries®.
Affiliate Partners may not create unauthorized discounts, make promises on behalf of The POWER of Elderberries®, or represent themselves as an employee or authorized representative of the company.
10. Prohibited Activities
Affiliate Partners may not engage in fraudulent transactions, manipulate referrals or tracking, create false customer accounts, purchase through their own referral methods to generate commissions, misrepresent The POWER of Elderberries® or its products, make unauthorized health or disease claims, distribute unsolicited spam, or use the Program in connection with unlawful or deceptive activity.
The POWER of Elderberries® reserves the right to review referral activity and investigate suspected violations.
11. Returns, Refunds & Cancellations
If a referred purchase is returned, refunded, canceled, disputed, or determined to be fraudulent or otherwise ineligible, any associated commission may be canceled, deducted, or reversed.
Customer purchases remain subject to The POWER of Elderberries®' current customer policies and Terms of Service.
12. Program Changes
The POWER of Elderberries® may modify the Program, including commission rates, eligible products, referral methods, promotional guidelines, payment procedures, or these Terms.
Material changes may be communicated to active Affiliate Partners through reasonable means, including email or the affiliate platform.
Continued participation in the Program following an applicable update constitutes acceptance of the updated Program Terms.
13. Suspension & Termination
Either the Affiliate Partner or The POWER of Elderberries® may end participation in the Program.
The POWER of Elderberries® may immediately suspend or terminate an Affiliate Partner for fraud, misleading promotion, unauthorized claims, misuse of intellectual property, violation of applicable law, violation of these Terms, or conduct reasonably determined to be harmful to the company, its customers, or its brand.
Upon termination, the Affiliate Partner must discontinue representing themselves as an active Affiliate Partner and discontinue unauthorized use of Program-specific brand materials.
Any unpaid commissions remain subject to verification, eligibility requirements, reversals, and these Terms.
14. Independent Relationship
Participation in the Program does not create an employment, agency, franchise, partnership, joint venture, or other legal representative relationship between the Affiliate Partner and The POWER of Elderberries®.
Affiliate Partners have no authority to enter into agreements, incur obligations, make guarantees, or otherwise act on behalf of The POWER of Elderberries®.
15. Limitation of Liability
To the fullest extent permitted by applicable law, The POWER of Elderberries® will not be responsible for indirect, incidental, special, consequential, or lost-profit damages arising from participation in the Program, including interruptions or errors involving third-party affiliate tracking or payment technology.
16. Governing Law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.
